Permit to Take Water (PTTW)

Ontario Ministry of the Environment, Conservation and Parks (MECP) · version May 31, 2021, Rev. 1

Cover letter / memo (signed) including

1Description of the proposed work, including the reason for the application and a list of the documentation attached

Application form

2MECP Permit to Take Water Application:
  • A completed, signed application form (Form 012-2167E)
  • All required supporting forms (i.e. Schedule for Water Conservation Measures for Category 1, 2 and 3)
3Review and administrative fee, payable to "Ontario Minister of Finance" by certified cheque, bank draft or money order in Canadian funds. Include purchaser's name and address. Payment may also be made by Visa, MasterCard or American Express.
4Part 8: Public Consultation / Environmental Bill of Rights requirements. This section asks two questions that determine whether the application may be subject to posting and/or public consultation under the Environmental Bill of Rights; examine it ahead of time to determine if any actions are required before submission.

Administrative documentation

5Consent of property owner:
  • If the Proponent does not own the land where the works are to be constructed, provide the land owner's signed document including name and address to allow the construction of the works
  • If the Proponent is not the sole owner of the land where facilities are being installed, provide written consent of all land owners
6If the proposed works cross railway rights-of-way or TTC tracks and/or are in TRCA lands, easements and/or within 300 m of a live railway, etc., provide evidence that notification and/or approval has been sought or granted, with backup documentation.
7Copy of the Easement Agreement, if executed, and the associated Registered Plan. All applicable easements must be labelled on all drawings.
8Proof of legal name and signing authority if the Proponent is a corporation: proof of legal name (e.g. Articles of Incorporation filed under the Corporations Information Act or the most current business registration under the Business Names Act, 1990) and a letter indicating proof of signing authority.
9Minister's Notice of Environmental Project Report: provide a copy of the letter from MECP.
10Complaints resulting from the water taking location: indicate whether you are aware of any complaints that have resulted from the taking of water at the location (e.g. interference with neighbouring wells, or downstream water use interference).
11Pre-submission meeting minutes (if applicable), especially in atypical cases (such as the ministry accepting a Category 1 application for a Category 3 project)

Drawings

12Map indicating the location of the proposed water taking(s) on a detailed topographic map. In southern Ontario use the Ontario Base Map (OBM) 1:10,000 scale series; in northern Ontario the OBM 1:10,000 or 1:20,000 maps for the area. Outline the property of intended water taking and mark and label: (i) all existing and proposed water taking locations with names of sources; (ii) all designated features within 500 m of the water taking location (see form).

Technical / supporting information

13Source location information (Category 1, 2 and 3). For more than one taking location, copy the Source Information section (pages 3–4 of the form) for each additional site.
  • Lot, concession, township, or city street address
  • Original geographic township (the original surveyed township, not a later amalgamated municipality)
  • UTM coordinates for the source of the water taking (GPS, or from an Ontario Base Map)
14Water in containers (Category 1, 2 and 3): indicate whether water is placed in containers at the site or incorporated into a product. The Water Taking Regulation (O. Reg. 387/04) limits transfers out of a water basin; if taking water for containerization, review the regulation or contact the Ministry's regional office.
15Well location and municipal water availability (Category 1, 2 and 3): distance to the nearest well and whether municipal water is available within 500 m of the water taking location.
16Description of operations (Category 1, 2 and 3): describe in detail how, where and when all water is obtained, stored, transferred, used and returned to the environment (if applicable), including the source of all water takings (and source name), purpose, period of water taking and maximum quantity requested. If the application is posted on the EBR Registry, this description is used for the Proposal Notice (the ministry may change the wording).
17Water taking needs (Category 1, 2 and 3): describe how water taking needs (rates, amounts and time periods) were determined, with all relevant information and calculations demonstrating the requested takings are warranted.
18Scientific Evaluation (Category 2): completed by a Qualified Person and attached to all Category 2 applications (Schedule 2 – Qualified Person Certification for Category 2 Groundwater Takings, or Schedule 3 – for Category 2 Surface Water Takings).
19Scientific Study Report (Category 3, hydrogeological and/or hydroecological study): completed by a Qualified Person for Category 3 applications (see the Technical Guide to Hydrogeological Studies to support Category 3 applications).
20Environmental Assessment (EA) or TPAP: provide proof of public consultation

Notes

21Categories of proposals for Permits to Take Water: proposals are classified by their anticipated risk to the environment; the greater the risk, the more evaluation required. Three categories are explained in the Guide to the Permit to Take Water application form.
22Niagara Escarpment Planning and Development Act: you may need proof of a Niagara Escarpment Development Permit or similar approval. A project subject to the Act without a development permit cannot be approved under the Ontario Water Resources Act. Contact the Niagara Escarpment Commission (905-877-5191, escarpment.org).
23Oak Ridges Moraine Conservation Act: check whether your water source is within the Oak Ridges Moraine Conservation Area using the maps at ontario.ca/page/oak-ridges-moraine (or request publication 5461 from the Ministry Public Information Centre, 1-800-565-4923).

This checklist identifies the scope of information typically required to support processing of an application. It is the responsibility of the applicant to consult with the approval authority prior to application submission to confirm the submission requirements for more complex or atypical applications.
